In exercise of the power conferred by section 56 of the Tourism Act. 2035, His Majesty's government has hereby made the following rules: -

1. Short title and commencement :

  1. These rules may be called "Mountaineering expedition Regulation 2036"
  2. This Regulation shall come into force at once.

2. Definition:

  1. Unless the subject or contest otherwise requires, in this Regulation "Act" shall mean the tourism Act, 2035.

3. Terms and conditions to be fulfilled by a Mountaineering Team :

Every mountaineering team, which has obtained a permit for mountaineering expedition, shall comply the following terms and conditions:

  1. The team shall confine its activities in climbing only the Himalayan peak for which a permit has been obtained.
  2. The team shall not indulge in any activities which may be contrary to the customs and religious, social or culture traditions of the local people of the area.
  3. The team shall set up the various cramps of its route to the base camp as far as possible, at such place which may be either acceptable to the local or as specified by His Majesty's Government for the purpose.
  4. The tea shall not take with it any arms, ammunition, explosives and mechanical instruments or devices other than those permitted by His Majesty's Government
  5. The team shall not indulge in any activity which is or may likely to affect adversely to the security and reputation of the kingdom of Nepal.
  6. The team shall not use any means of communication other than those approved for the purpose.
  7. The team shall not damage or destroy any tree, shrub or other forest sources existing in the adjoining area or on the route of its expedition.
  8. The team shall submit all the rare objects, which may be found by it during the continuation of expedition, it His Majesty's Government through the Liaison Officer.
  9. The mountaineering team obtaining the permit for expedition to such Himalayan peak which situated on the joint boundary of the Kingdom of Nepal and of the neighboring foreign state shall not violate crossing the international boundary.

4. Insurance against Personal Accident :

  1. Every mountaineering team shall insure the Liaison a Officer headman, mountain guide and high altitude porters, workers of the base camp and local porters against personal accident for the following amount so as to cover the duration from the date of departure for expedition until the date of return after completion of the expedition:

    Departure for expedition until the date of return after completion of the expedition:

    I) For Liaison Officer Two hundred thousand rupees
    ii) For headman and mountain guide One hundred and fifty thousand rupees.
    iii) For the high altitude porter One hundred rupees
    iv) For workers of the base camp Fifty five thousand rupees.
    v) For local porters Fifty thousand rupees
